Project description

Article 18 of the ICCPR understands freedom of religion as including “respect for the liberty of parents and, when applicable, legal guardians to ensure the religious and moral education of their children in conformity with their own convictions”. How should we understand the moral basis or the moral justification of the freedom of parents to educate their children according to their own religious convictions? What are the limits of parental rights to educate their children according to their own convictions?

This workshop will address normative issues at stake at the interplay of children’s right to education, parental authority and the state’s role in the establishment and enforcement of educational standards as well as in the funding of religious or separate schools.

  • Can the freedom of parents to ensure the moral and religious education of their children in conformity with their own convictions conflict with the state attempts to educate future citizens?
  • What weight should we give to the children’s rights and interests in receiving an autonomy-enhancing education when those interests conflict with parents’ beliefs?
  • How should we weight the claims of parents and those of the state in situations in which they conflict?
  • What role can or should separate or private religious schools play in accommodating ethnocultural minority groups?
  • What limits should the liberal state place on the teachings provided in such schools?
  • Can religious schools legitimately exclude pupils and employees on the basis of religious or ethnoreligious criteria?
  • Shouldthe liberal secular state finance private religious education?
